Acceptance of Terms

By downloading, installing, or using MoodKit ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

1. License Grant

MoodKit grants you a personal, non-exclusive, non-transferable, revocable, and limited license to download and use the App on Apple devices that you own or control, solely for personal, non-commercial purposes. This license does not permit you to distribute, sublicense, reverse-engineer, decompile, or create derivative works based on the App.

2. User Responsibilities

You are solely responsible for maintaining the confidentiality and security of your device and your Apple ID associated with iCloud Sync. You agree to use the App in compliance with all applicable laws and regulations. You shall not use MoodKit to store, transmit, or distribute any content that is unlawful, harmful, or violates the rights of others.

3. Privacy and Data

Your use of MoodKit is also governed by our Privacy Policy, which describes how we handle your data. MoodKit is a local-first application — your personal content is stored on your device and, if enabled, synced via Apple's iCloud infrastructure. We do not access, collect, or store your personal mood or journal data on our servers.

4. Subscriptions and Payments

MoodKit offers optional premium features through a subscription plan. All subscriptions are processed and managed through the Apple App Store. Payment will be charged to your Apple ID account at the time of purchase confirmation. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your App Store account settings.

5. Free Trial

MoodKit may offer a free trial period for premium features. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan at the advertised rate. Unused portions of a free trial will be forfeited upon purchasing a subscription.

6. Intellectual Property

All content, design, graphics, trademarks, and intellectual property within MoodKit are owned by MoodKit and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reproduce any part of the App without prior written consent.

7. Health Disclaimer

MoodKit is designed as a personal wellness tool for self-reflection and mood tracking. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. The insights and information presented within the App should not be considered a substitute for professional medical or psychological advice. If you are experiencing a mental health crisis, please contact a licensed healthcare provider or emergency services immediately.

8. Disclaimer of Warranties

MoodKit is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Your use of MoodKit is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MoodKit and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or in connection with your use of the App.

10. Termination

We reserve the right to suspend or terminate your access to MoodKit at our discretion, without prior notice, if we determine that you have violated these Terms of Service. Upon termination, your license to use the App will immediately cease.

11. Changes to These Terms

We may revise these Terms of Service from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the App following any modifications constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
